ABBEY SPANIER INVESTIGATES VILLA PIZZA AND VILLA ENTERPRISES FOR UNFAIR EMPLOYMENT PRACTICE
If you now work or did work as a Co-manager or Assistant Manager for any of the restaurants operated by Villa Enterprises, including, Villa Pizza, Villa Fresh Italian Kitchen, Green Leaf’s, Bananas, and South Philly Steaks & Fries you might be owed overtime pay. We have learned that Villa Co-managers or Assistant Managers work more than 40 hours per week without receiving overtime. We are investigating whether Villa classifies its Co-managers or Assistant Managers as “exempt” in violation of the overtime requirements of the federal Fair Labor Standards Act (“FLSA”) and state wage and hour laws.
Abbey Spanier is investigating whether Villa’s Co-managers or Assistant Managers are acting in a true managerial or executive capacity so as to qualify for the overtime exemption under federal and state labor laws. The key issue is whether these employees spend significantly more than 50 percent of their time during each work shift performing non-managerial tasks like those of hourly paid employees. Although the FLSA allows an overtime exemption for management employees who spend most of their time managing, often employees are given a “manager”, “co-manager” or “assistant manager” title but spend most of their time performing the same tasks as the restaurant crew such as serving food to customers, cashiering, preparing food and cleaПing. In that case, employees who are “salaried” are still entitled to overtime pay for their time worked over 40 hours per week. Many of these “managers” are expected and do work 50 or 60 hours a week for no extra pay which would be illegal.
If Abbey Spanier’s investigation reveals that Co-managers or Assistant Managers do not qualify for an “exempt” classification, these employees may be entitled to unpaid overtime and other benefits under the FLSA and state wage and hour laws.
